NextPlay

Please read these terms before using NextPlay.

1. Acceptance of Terms

By downloading, installing, or using NextPlay (the App), you agree to be bound by these Terms of Service (Terms). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and NextPlay / Skillforge (Company, we, us, or our).

2. Eligibility

You must be at least 13 years of age to use NextPlay. By using the App, you represent that you meet this requirement. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

3. Account and Access

NextPlay may be used without creating a traditional account. We assign an anonymous user ID automatically.
You are responsible for maintaining the security of your device and any account credentials.
We reserve the right to suspend or terminate access for violations of these Terms.

4. Permitted Use

NextPlay grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes. You agree not to:

Copy, modify, distribute, or create derivative works of the App.
Reverse engineer, decompile, or disassemble the App.
Use the App for any unlawful purpose or in violation of any regulations.
Scrape, crawl, or use automated means to access the App or its underlying APIs.
Attempt to gain unauthorized access to any part of the App or its related systems.
Use the App to infringe the intellectual property rights of any third party.

5. Game Data and Third-Party Content

NextPlay displays game data, cover art, ratings, and metadata sourced from IGDB (powered by Twitch). This data is owned by its respective rights holders. NextPlay does not claim ownership of any game titles, artwork, or trademarks displayed in the App.

Links to external storefronts (App Store, Google Play, Steam, etc.) are provided for convenience only. NextPlay is not responsible for the content, pricing, or availability of games on third-party platforms.

6. Premium Subscription

6.1 Subscription Plans

NextPlay offers a premium subscription (NextPlay Premium) that unlocks smart game recommendations. Subscription options include monthly and annual plans.

6.2 Billing

Subscriptions are billed through the Apple App Store or Google Play Store. Payment will be charged to your account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

6.3 Cancellation and Refunds

You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellations take effect at the end of the current billing period. Refunds are subject to Apple's and Google's refund policies. NextPlay does not issue refunds directly.

6.4 Price Changes

We may change subscription prices at any time. Price changes will take effect at the start of the next subscription period. We will notify you in advance of any price change.

6.5 Free Tier

NextPlay's core features (game tracking, search, basic Play Next) are available for free. Free users will see banner advertisements served by Google AdMob.

7. Advertisements

Free users of NextPlay will see banner advertisements provided by Google AdMob. By using the free tier, you consent to the display of ads. Premium subscribers do not see advertisements.

NextPlay is not responsible for the content of third-party advertisements. Clicking on an ad may take you to a third-party website or app governed by that third party's own terms and privacy policy.

8. Intellectual Property

The App, including its design, code, graphics, and original content, is owned by NextPlay / Skillforge and protected by intellectual property laws. The NextPlay name and logo are trademarks of Skillforge.

You may not use our trademarks, logos, or branding without prior written consent.

9. User Content

Any content you create within NextPlay (game lists, ratings, preferences) remains yours. By using the App, you grant us a limited license to store and process this content solely to provide the App's services.

You represent that your use of the App does not violate any third-party rights.

10. Disclaimer of Warranties

THE APP IS PROVIDED AS-IS AND AS-AVAILABLE WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses. Game data is sourced from IGDB and may be incomplete or inaccurate.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXTPLAY / SKILLFORGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA OR PROFITS, ARISING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR A SUBSCRIPTION IN THE THREE MONTHS PRECEDING THE CLAIM, OR $10, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless NextPlay / Skillforge and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys fees) arising from your use of the App or violation of these Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction.

14. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by updating the Last Updated date. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.

15. Termination

We reserve the right to suspend or terminate your access to NextPlay at any time, for any reason, including violation of these Terms. You may stop using the App at any time. Sections 8, 10, 11, 12, and 13 survive termination.
